Introduction VAD respects each individual’s right to personal privacy. We will collect and use information through our upload wizard, from users signing up to receive the VideosAfterDark.com newsletter, and in any other way disclosed in this Privacy Policy. VAD has no responsibility for content on websites other than VideosAfterDark.com you may come across while navigating VideosAfterDark.com. Similarly, VAD has no responsibility for content accessed on or through the Website that is created or posted by anyone other than authorized VAD employees, agents and/or representatives. This statement applies solely to information collected on or through the Website from all users (“Users”) and others who access this Website.

We are a Data Controller A “controller” is the legal entity which, alone or jointly with others, determines the purposes and means of the processing of personal data. VAD is the data controller for data described by this policy.

We are also a Data Processor A “processor” is a legal entity or other body that processes data on behalf of the controller, as defined above. VAD may use various data processors with which we have data processing agreements. VAD is also the primary data processor for data described in this policy. We have a lawful basis and a legitimate interest in collecting, retaining, and processing your data.

Information We Collect You may browse much of the Website without providing us with any personal data. If you choose to upload a video (which will create an account for you), sign up for a newsletter, or send us a message, we will collect certain information about you, depending upon what you do. For instance, if you send us a message, we’ll collect the information in the message (which could include information from your signature or other information you provide us) and your email address. If you choose to upload a video pursuant to our terms and conditions , we will collect your name, phone number, email address, mailing address, age group, and gender, through our upload wizard and through the forms Users fill out when signing up to receive the VideosAfterDark.com newsletter, which is used to promote the VAD television show and may provide you with special offers and information from companies and products we think might interest you. We may also collect information that you have made public on public websites. We may combine this data with the information you have provided voluntarily (such as your email address).

Technical Information We Collect We have a legitimate interest in ensuring that our Website operates correctly and efficiently. When you visit and/or interact with our Site, we collect limited data that the browser you used makes available automatically. This information includes the internet address of the computer or network you used to access our Site, the date, time, and page(s) you visited on our Site, the browser and operating system you used, and the referring page (the webpage that contained the link to the Site that you clicked on to get there). Once you leave our site, you have the right not to be followed. When you first access our home page, you will see at the bottom of the page an option to reject any unnecessary cookies. Please see our section below on cookies, where we identify the digital content we collect when you visit our Site, some of which is necessary to properly navigate the Site.

When you use a device like a computer, tablet or phone to access our Website, VAD may access, collect, and/or store one or more “device identifiers” from your device, including without limitation, your IP address, device model/type, OS version, and UDID numbers. The purpose of this is to help prevent malicious users from interacting with the VAD Website community in an inappropriate manner, and to make efforts to ensure the website is optimized accordingly. We have a legitimate business interest in collecting this data for the safe operation of the site. It is not combined with other information to identify you.

Sharing and Disclosure of Your Information With your consent, we will use your e-mail address and/or other personal information to provide you with information we think you will be interested in, including company news and related product, company, or service information, and marketing content. Even after you have agreed to receive such messages, you can let us know at any time if you would prefer not to receive any or all of this marketing/investor information by following the unsubscribe instructions contained in any email you receive from us or by sending an e-mail to GDPR@VideosAfterDark.com that contains the email address you wish us to unsubscribe from our lists. As noted above, even if you opt out of receiving marketing messages, we will still send you important non-commercial messages as long as you have an account with us or have uploaded a video.

We have a legitimate interest in complying with our legal obligations. Accordingly, we may release user data if we believe in good faith that it is required (i) where disclosure to a governmental entity is required or so ordered by a court of competent jurisdiction, (ii) if determined in the sole discretion of VAD that a crime or breach of public safety has or will occur; or (iii) if it is required in order to determine and/or evaluate claims of ownership.

Disclosure of Information in the event of Business Transfer In the event that VAD is involved in a merger, bankruptcy, acquisition, reorganization or sale of assets, your information may be sold or transferred as part of that transaction. The covenants in this Privacy Policy will apply to your information as transferred to the entity that results from that transaction.

Disclosure of Non-Personal or Non-Private Information VAD may share or disclose your non-private, aggregated or non-personal information. No individual or personally identifiable information will be shared without your consent.

Aggregate Nonpersonal Data We may share aggregate and non-specific demographic data with the following third parties: advertisers, sponsors, and investment firms. However, we will not provide those third parties with data such as names, ages and email addresses without your consent. VAD does not sell or share personal information for commercial purposes without your consent.

Disclosure to Third-Party Service Providers and Processors With your consent, VAD may share or disclose your data, such as when you take advantage of offers or promotions we may offer from time to time that require fulfillment by a third party. If VAD uses a third party processor or provider to send you a newsletter or an administrative notice pertaining to your account or any video you have uploaded, VAD will ensure that the that processor handles your data in accordance with the terms of this Policy.

In addition, you have the option to use the VAD bookmarking and sharing tool on our web pages powered by third-party application service providers, such as YouTube, Facebook, Twitter, Instagram, etc. Please see the respective third-party’s privacy policy for their standards and policies as they may differ from ours.

We use Google Analytics to let us know what pages are being accessed on our site, what is being viewed, and if you have allowed it, what interests the viewer (you) have based upon your browsing and what is being viewed, but none of the details we collect are attached to marketing tools that can connect the information to your identity. We use the information to update our websites and created more relevant contact and destroy it after 30 days.

Access and Control of Your Data Pursuant to your reasonable request, we will provide you or a third-party you specify with a list of all of the personal data that VAD has collected and/or shared, in a form that is portable to you. Depending upon your geographic location, we may charge a small fee to collect this information in a portable fashion. Similarly, upon your request, we will make corrections to our records of your personal data. You may send an email to us at GDPR@VideosAfterDark.com with your request. Please be sure to provide all relevant email addresses associated with your request.

Retention and Deletion Your data is stored and processed in the United States.

We keep your data only for as long as we have a legitimate business purpose, and only that data required for the particular purpose for which we collected the data. We will retain your data while you have an active relationship with VAD, including if you have subscribed to a newsletter, opted in to receive commercial and marketing content from us, or if you have affirmatively made requests of us that we, or our data processors, are fulfilling. If you have uploaded a video, we must retain the information you provided at the time of upload indefinitely, as it is required for legal purposes relating to the ownership of the video.

We will maintain your data for one year after that relationship ends, unless you request that we delete your information prior to the expiration of that period, which you may do at any time following the instructions below. If VAD determines that it no longer requires your data for the purposes set forth above, including any legal purposes, it will delete your information without you making a request.

If you would like us to delete all of your data (including any personal information gathered by our service providers) and/or place your name on our “do not contact” list, contact us at GDPR@VideosAfterDark.com include “GPDR Delete Request” in the subject line, and request that your information be deleted and/or that you be placed on our “do not contact” list. Please note that because names may be similar, you must include in your request all associated email addresses and phone numbers (if any) that you wish to be deleted in the body of the email. We reserve the right to contact you for administrative purposes to request more information in order to assist us in completed your request. We may also send you a confirmation email, once we have deleted your information. Please note that if you have uploaded a video, your information will not be deleted, because we have a legal obligation to hold your data for the life of the copyright of the video.

We will make commercially reasonable efforts to delete your information within thirty days from our active files, provided, however, that we may retain—for legal compliance purposes only—your request and associated email in a hashed format so that we do not inadvertently restore your information to our database. You may also request that we stop processing your information without deleting it, and we will comply within five days of receipt of such a request. Notwithstanding the above, VAD will retain your information indefinitely if it believes in good faith that it has a legal obligation to do so.

Cookies Certain cookies placed by our site do not collect any personal information, and are essential to provision of a functional Website, which we have a legitimate interest in providing (these are known as “Necessary Cookies” and include cookies that drive your navigation on our Site). The use of cookies is a standard practice among Internet websites and most Internet web browsers may be customized to reject cookies, to only accept or reject cookies by user intervention, or to delete cookies. However, some features may not function properly if all cookies are blocked, as discussed above. Necessary Cookies are required for functionality of the Sites, and when you leave the Sites’ environment, those cookies are no longer stored. External Links On Our Website Our Site may contain links to other sites. Those sites may have their own privacy policies, or no privacy policies at all. VAD is not responsible for the privacy practices employed by other sites and those other sites may not have agreed to our privacy policy. VAD has no control over or responsibility for any unaffiliated third party sites or the content contained in them, and we provide these links solely for the convenience of our visitors. We do not sponsor, endorse, or otherwise recommend such sites and only endorse VAD products on those sites. In short, once you leave our Site, we are no longer responsible for the collection practices of the companies operating those sites

Our Video Player We may use clips from the video you submitted in our video player, a feature of the website.

Kids Policy The VAD site is a general audience website, intended for adult use. We do not market to, and do not knowingly collect any data from, children under sixteen (16) years of age. Please contact our customer service department if you are aware of any personal information supplied to the Site by a child under the age of sixteen (16). If you believe we have collected information from a child under the age of 16, it should be reported to GDPR@VideosAfterDark.com.

Do Not Track The Do-Not-Track Signal (“DNT”) is used by some web browsers to automatically request that a web application disable site tracking. Because the DNT often does not reflect the actual preferences of an individual consumer, our websites do not respond to the DNT. Your browser, and this privacy policy provides you with instructions and information on how to disable cookies.
